Two of 15 Mitchell businesses checked Oct. 2 by the South Central Alcohol Task Force failed alcohol compliance checks.
Dakota Sunset and Kwik Phil each failed checks. In both cases, the clerk asked to see the confidential informant?s identification but still made the sale of alcohol to an underage buyer.
This is Dakota Sunset?s third failure in a 24-month period and Kwik Phil?s second failure in a 24-month period.
The penalty for failing an alcohol compliance check is increased if a business fails multiple times in 24 months.
On a first offense, if a person who sells alcohol to a minor has passed a certified alcohol management class, the state can fine that business $500. On a second offense within 24 months, the business is fined $1,000. If the seller has not passed the class, the fines are doubled.
For a third offense in a 24-month period, the South Dakota Department of Revenue can suspend the business? liquor license for up to 14 days.
The following businesses were checked and passed: Freedom Valu Center, County Fair Food & Fuel, Cubby?s West, M&H, Walgreens, All-Star Convenience Store, Graham?s Mobile, Thunderbird Lodge, Highland Travel Plaza, Walmart, Rob?s Short Stop, Arnie?s First & Foster and Thirsty?s.
